Welcome to mediumpixel. By accessing our website or engaging our UI/UX design services, you agree to be bound by the following terms and conditions. Please read them carefully.
Scope of Services
mediumpixel provides professional UI/UX design, wireframing, prototyping, and brand identity services. The specific scope of work, deliverables, and timelines for any project will be outlined in a separate Project Proposal or Statement of Work (SOW).
Client Responsibilities
To ensure a successful design outcome, the client agrees to:
- Provide timely feedback and approvals.
- Supply necessary brand assets, content, and access to relevant data (e.g., GA4/Hotjar insights) if required for the project.
- Warrant that all materials provided to mediumpixel do not infringe on any third-party intellectual property rights.
Payment Terms
- Deposit: A non-refundable deposit (typically 50%, unless otherwise stated) is required before work commences.
- Milestones: For larger projects, payments may be tied to specific milestones (e.g., Wireframe Approval, High-Fidelity Design).
- Late Payments: mediumpixel reserves the right to suspend work if invoices remain unpaid past the due date.
Revisions and Scope Creep
Our standard proposals include a set number of revision rounds (usually 2 or 3).
- Revisions: Changes within the original scope of the project.
- Scope Creep: Any request for additional features or pages not defined in the initial SOW will be billed at our standard hourly rate or quoted as a separate add-on.
Intellectual Property (IP) Rights
- Transfer of Rights: Upon final payment, the full ownership and copyright of the final visual designs and assets are transferred to the client.
- Retained Rights: mediumpixel retains the right to display the project in our portfolio, case studies, and marketing materials (unless a specific Non-Disclosure Agreement is in place).
- Preliminary Work: mediumpixel retains ownership of all discarded concepts, sketches, and internal working files not included in the final delivery.
Term and Termination
Either party may terminate a project with written notice. In the event of termination:
- The client will be invoiced for all work completed up to the termination date.
- mediumpixel will deliver any completed assets for which payment has been received.
Limitation of Liability
While we strive for design excellence and conversion-focused results, mediumpixel is not liable for any indirect, incidental, or consequential damages (including loss of profits or data) arising from the use of our designs or the performance of the client’s final product.
Confidentiality
Both parties agree to treat all business information, project strategies, and trade secrets shared during the engagement as strictly confidential.
